Warranty
- Masimo warrants that; (i) it will perform the services using qualified personnel in accordance with industry standards and (ii) any repair or replacement provided under the services will be free from material defects in materials and workmanship.
- The duration of this warranty shall be 90 days from the date of performance, repair, or replacement.
- Masimo’s obligation if OOW Device is found by Masimo to be defective during the warranty period shall be limited to repair or replacement.
- This warranty does not apply or extend to any OOW Device (a) damaged, neglected, misused or improperly operated, (b) modified, disassembled, or reassembled, (c) used with supplies, devices or electrical work external to the OOW Device, (d) where the software has been damaged, modified by anyone other than Masimo or without the express written authorization of Masimo, or (e) used contrary to Masimo’s instructions.
- MASIMO MAKES NO OTHER WARRANTIES AND DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED.
